Advice needed; Court summons for non payment of council tax

Hi folks

We've just received a summons for non- payment, which is a bit of a bolt from the blue as we are currently appealing and are in arrears of £270.78 (!!!) from November to March. We were in reciept of council tax "benefit" but this was bumped to half n' half. As we don't have the money to pay the damn thing, and are behind on everything, we were awaiting a decision for a discretionary housing payment, so weren't expecting to hear from a court for some time (perhaps a bit naive and optimistic of us, as these ****s are ever eager to whack "court costs" on top of anything else).

The summons is a blue piece of paper (is this real or fake?)and the court date is april 25th

Does anyone have any advice on the best way to deal with this?

You have two choices really, play buy their rules or play by yours.

You can plead guilty/not guilty and maybe add mitigating circumstances, ie financial troubles and hope the judge will be merciful. This will raise extra cost ontop of what you already allegedly owe, but the judge may be able to arrange payments as low as £5 per week for the outstanding debt. But you WILL be "given the impression" that you have to pay, or the judge may have it automatically stopped from benefits if you are receiving them.

Not giving the judge duristiction could be another route. Claim to be a flesh and blood being making a special appearance on behalf of "your name" ask the judge and prosecution what authority they have to use the name, when it s called out ask them if they are addressing you, they can't! They want you to admit. Always answer with a question, as'king. don't argue or you will be seen as belligerent and dishonourable And be found in contempt. have witnesses and court staff sign affidavits to say you were there on said day as they may try throw a falling to appear at you for not "admitting" this may be evidence to give to police to say you was there when they try to say you wasn't.

Others Try to get the crown to acquiesce by asking for proof of claim and defaulting them when they fail to produce.

Weather or not you have been dishonourable already could help your defence should you decide to plea! Have you notified the council tax office you were having dificulty? Had you paid a little (1 or 2 quid a week) it would have kept you in honour and perhaps out of court. If you have been corresponding with the CTO, and you have been summonsed anyway, they may be in dishonour.

Also I've heard they are not actual judges at council tax court, the council hire the out for the day and fill it with their own officials. If this is true, you stand little chance of "winning" either way. Just bits n bobs you might find useful that I've herd, not tried n tested. :)

I would recommend making a call to your council, and speak to the collections manager likely it’s a private company (capita or Serco).

If you are eventually planning on paying it, once your finances improve, I would make them this offer, and say take it or leave it, and be sure to say you’re not refusing to pay, if they say they will still take you to court, then your best speaking to the magistrates, and insist that you do, explain your situation, and you may be able to set up a payment plan, that is a lot less than what you could otherwise have done before.

If you’re going to challenge the facts of the complaint as to the applicability of the statute, and fact proving an obligation exists etc, that is something I can help you with, so let me know what you intend to do, and I’ll do whatever I can to help, if you’re on Skype it’s best we hook up through that forum.

I would stay away from the freeman, commercial redemption, trust law stuff, it’s a red flag in the courts now, and you’ll be kicked out unheard or worse, you’re not dealing with people who know or even understand the “law” being forced upon you, they are useful idiots so such methods don’t work especially in magistrates courts.

It's early days (this came as a bolt from the blue, as we cluelessly assumed there was some kind of communication between the billing and benefit's departments...but no, that would mean things "working" and less opportunity to trip people up) and we've been run off our feet with lots of other nonsense. It's being dragged through the courts. We've basically been passed from pillar to post, with errors (on the part of Dartford council) continually recurring in their "case" against us, regardless of countless letters and attempts to set the record straight. It seems their policy is that of wearing one down, through threats, incompetence, and generating confusion. We've said we're willing to pay a certain amount (no where near what their asking of us) and are hoping that we can get them to accept a nominal payment. As others have said, their now pretty wise to the freeman argument now and, unless your prepared to devote a huge amount of time to your case, you're going to have a hard time pleading the (correct, of course) inherent criminality of their racket

The summons is printed by the council and bears a photocopied signiture! they always do.But HMCS will tell you that this is LEGAL as it was sent by a JP (Bullshit) Our Courts allow LAs to do as they please in this mock up Hearing Ive been through the whole process COUNCILS EVEN PRINT THEIR OWN ARREST WARRANTS !
